用途発明
最近、医薬以外の用途発明が認められにくくなったという話を聞く。
実際私の担当案件でも、化粧品だが、用途発明として認められないということで拒絶理由をもらった。
医薬の場合は、用途が明確だが、化粧品や食品はそれほど明確に用途を意識して購入することが少ないかららしい。
それでも用途を明確にした商品の場合に認められる場合もあるのだが、現状ではそうした化粧品、食品は少ないらしい。
地域興しやベンチャーには食品の用途発明を認めてもらいたいものだ。地域ブランドのように、特産品に限って機能性食品としての用途発明を認めてはもらえないのだろうか？
いずれにしても、プロパテント、知財立国と言いながら審査、審判がどんどん厳しくなっているように感じるのは私だけだろうか？
